Subject: Request for issuing directions to the Director FSL for providing FSL
results in the case, on priority.
Hon'ble Sir,
The brief facts of the case are that on 22.12.2000, an incidence of firing/attack in the
Red Fort. Delhi by the terrorists of banned terrorist organization Lashkar-e-Toiba (LeT),
who armed with AK-56/47 rifles entered into Red Fort and fired of the security forces,
deployed in the security of the Red Fort. Total three army personnel died in the incidence.
On the same day, the terrorist organization, Lashkar-e-Taiba (LeT) has .claimed for the
above mentioned attack on Red Fort. Accordingly, the above mentioned case vide FIR No.
688/2000 dt. 22.12.2000, was registered at PS Kotwali, Delhi. Subsequently, the
investigation of the case has been transferred to Special Cell, Delhi. During the investigation
of the case, earlier total II accused were arrested. However, all the accused persons have
been acquitted/discharges by the Hon'ble Trial/appellant courts, except one accused namely
Ashfaq Ahmed @ Abu Hamaad @ Mohd. Arif r/o. Pakistan, whose death penalty was
confirmed by the Hon'ble High Court and later on by the Apex court on I 0.8.20 II. In this
case. several accused persons including the above mentioned accused Bilal Ahmed Kawa,
were declared as PO by the concerned court of Sh. A.K. Sarpal, MM, Tis Hazari Courts,
Delhi vide orders dated 04.05.200 L
Later on, the present accused namely Bilal Ahmed Kawa, R/o Srinagar, Jammu
Kashmir, was arrested in the case on 10.01.2018, who is presently on bail vide orders dated
07.02.2018, ti-om the Hon'ble court of Sh. Sidharth Sharma, ASJ (FTC), Patiala House
Courts, Delhi. In this regard, it is submitted that during the investigation of the case, some
exhibits i.e. mobile/SIM card and handwritings of the accused were sent to the FSL!Rohini,
Delhi for extracting the data and expert opinion, vide their acknowledgement Nos. FSL-
2018/DOC-2512 dated 28.03.18 (in Documents Section) and FSL/20 18/C:FU-2458 dated
27.03.18 (in Computer Section). However, despite of various requests and priority letters
(dated 23.05.18. 04.07.18, 17.09.18 & 01.10.18), FSL result related to the mobile/SIM has
not been provided by the concerned authorities of FSL/Rohini, Delhi.
ln view of the above, it is humbly prayed that directions may please be issued to the
Director. FSL, Govt. of NC:T Delhi, RohinL New Delhi. for providing the result in the case
on priority, so that the charge sheet against the accused, may be tiled in the Hon'blc court at
the earliest
